General Terms and Conditions 

 

1. Scope and Purpose of the Website

 
 
  • Informational Nature: This website serves exclusively as an information platform for Smawatec products and services.

  • No Direct Sales: No legally binding purchase contracts for hardware are concluded through this website.

  • Territorial Scope: These terms are governed by the laws of the European Union, specifically targeting the German and French markets.

 

2. Product Nature and Regulatory Status

 
 
  • Non-Certified Flowmeter: The Smawatec Flow-stopper is a non-certified monitoring device.

  • Secondary Installation: The device must exclusively be installed after (downstream from) the officially certified main water meter and shut-off valve provided by the local utility.

  • Reference Only: Measurements provided by the software are for reference and monitoring purposes only and cannot be used for official billing or legal metering disputes.

 

3. Software Usage and Subscription

 
 
  • Free License Period: For private consumers, Smawatec provides access to the monitoring software/app free of charge for a period of five (5) years following the initial activation of the hardware.

  • App Requirement: Usage of the Flow-stopper requires a compatible smartphone (iOS or Android) and the installation of the Smawatec app.

  • Service Availability: While Smawatec strives for high availability, we do not guarantee 100% permanent uptime of the cloud services or app functionality. Maintenance windows and third-party network outages (Wi-Fi/LORA) are excluded from liability.

 

4. User Responsibilities and Installation

 
  • Professional Installation: Smawatec strongly recommends that the physical installation of the device be performed by a certified professional.

  • Technical Prerequisites: The user is solely responsible for ensuring:

    • A stable and permanent Wi-Fi or LORA network connection at the installation site.

    • A suitable installation location in compliance with the Installation Documents for the respective smawatec product.

    • Proper power supply (220–240 V / 50 Hz) protected from water and short circuits.

       Physical Constraints: The user must ensure the pipe section allows for the minimum installation length of 238 mm plus fittings.
 

5. Exclusion of Liability 

  • Installation Risks: Smawatec is not liable for damages (including water damage or pipe bursts) resulting from improper installation, failure to hire a professional, or failure to follow the installation guide. 

  • Welding Prohibition: Liability is void if welding is performed within 3 meters of the device, as this destroys the electronics and sensors.

  • Detection Limitations: The Flow-stopper is a monitoring aid. Smawatec does not guarantee that 100% of leaks will be detected or that the device will prevent all water damage.

  • Property Damage: To the maximum extent permitted by law (especially in B2B contexts), Smawatec’s liability for secondary property damage resulting from undetected leaks is excluded.

  • Water Quality and Pressure: Liability is excluded for damages caused by water pressure exceeding 5 bar or temperatures outside the 0 to 40 °C range.

 

6. Data and Privacy

 
 
  • Account Security: Users are responsible for securing their app login credentials.

  • Telemetry Data: By using the software, the user acknowledges that water flow data is transmitted to Smawatec servers for the purpose of leak detection and system alerts.

 

7. Intellectual Property

 
 
  • Proprietary Rights: All website content, hardware designs, and software code are the intellectual property of Smawatec. Unauthorized reproduction or reverse engineering of the device or app is strictly prohibited.
